Police to withdraw poll-linked case against Dikshit

New Delhi, Feb 6 (IANS) Delhi Police Monday moved an application in a court here seeking withdrawal of a case against Chief Minister Sheila Dikshit for allegedly violating the election code and provisions dealing with loudspeakers and other accessories during the 2008 assembly polls.

An additional chief metropolitan magistrate, after hearing the submission made by police, listed the matter for Feb 15.
The application was on a complaint filed by Samajwadi Party candidate Om Prakash alleging that Dikshit violated the election code during the campaign by using loudspeakers without permission.
Seeking withdrawal of the case, police said that no loudspeaker or other accessories were seized during investigations.
“Accused (Dikshit) has been booked and challaned for violations of section 112 of the Delhi Police Act…However, a bare perusal of the same makes it clear that the said section is not attracted to the facts of this case at all and thus it is clear that accused has been challaned under wrong penal section.”
Police said their records did not suggest that the Election Commission had taken any action in this case as it pertained to violation of the model code of conduct.
